How Texas classifies misdemeanors

Texas separates misdemeanors into three classes. The class determines the maximum penalty and where you serve any sentence. In every category, a conviction creates a public criminal record that employers, landlords, and licensing boards can see.

  • Class A misdemeanor: up to 1 year in county jail and up to a $4,000 fine.
  • Class B misdemeanor: up to 180 days in county jail and up to a $2,000 fine.
  • Class C misdemeanor: fine only, up to $500, but still creates an arrest record.
